1. Purpose and acceptance

These Terms govern access to and use of Encario (the “Platform”), a software for managing the sale, rental and control of machinery, available as a web app and a mobile app. By registering or using the Platform you accept these Terms and the Privacy Policy. If you do not agree, do not use the service.

2. Service provider

3. Accounts and access

To use the Platform you must create an account or sign in with your Google account.
You are responsible for keeping your credentials confidential and for all activity under your account.
You must provide accurate information and keep it up to date.
Access to each company’s data is subject to the role your organization assigns you.

4. Acceptable use

You agree not to:

Use the Platform for unlawful or unauthorized purposes.
Access company or user data without authorization.
Attempt to compromise the security, integrity or availability of the service.
Upload content that infringes third-party rights or applicable law.

5. User content

The data and documents you enter into the Platform remain owned by your company. You grant us a limited license to host and process them for the sole purpose of providing the service. You are responsible for the legality and accuracy of the information you enter.

6. Plans and payments

Access may be offered for free or through paid plans. The prices, billing periods and conditions of each plan are shown at the time of purchase. Payments are processed through external providers (e.g. Stripe). Non-payment may result in suspension of the service.

7. Intellectual property

The software, the “Encario” brand, the designs and the Platform’s code are owned by the provider or its licensors. These Terms do not transfer any rights to you beyond the use of the Platform as set out herein.

8. Service availability

We work to keep the Platform available and secure, but we do not guarantee uninterrupted operation. We may carry out maintenance, update or improvement tasks that temporarily affect the service.

9. Limitation of liability

To the extent permitted by law, we will not be liable for indirect damages, loss of profit or loss of data arising from the use or inability to use the Platform. We recommend keeping backups of information that is critical to your business.

10. Suspension and termination

You may stop using the Platform and request the closure of your account at any time by writing to support@encario.com. We may suspend or terminate access in the event of a breach of these Terms.

11. Changes to these terms

We may modify these Terms to adapt them to legal or service changes. We will publish the current version on this page, indicating the last updated date.

12. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts of [locality pending, based on the registered address], unless consumer protection rules establish a different venue.
